General Information
The Nutrient Management Act, 2002 ("Nutrient Management Act")
Regulation (O. Reg 267/03) and Construction and Siting Protocol set
out the standards for the construction and siting of nutrient storage
facilities.
It should be remembered that construction and siting of a permanent
nutrient storage facility may be subject to other regulatory restrictions.
When farmers are considering how they will address storage on their
farm they should have regard to the wide range of regulatory requirements
that also address this issue.
Other pieces of legislation that the farmer should have regard to
include, but are not limited to:
- The Building Code Act, 1992, S.O. 1992, c.23 and associated
regulations;
- The Drainage Act, R.S.O. 1990, c. D.17 and associated
regulations;
- The Environmental Protection Act, R.S.O. 1990, c. E.19
and associated regulations;
- The Ontario Water Resources Act, R.S.O. 1990, c. O.40
and associated regulations;
- The Fisheries Act, R.S.C. 1985, c.F-14 and associated
regulations; and
- The Oil, Gas and Salt Resources Act, 1990 and associated regulations;
- Municipal by-laws which may apply
Conformity with the Nutrient Management Act and Regulation does not
ensure conformity with these other regulatory requirements. It is
the farmers' responsibility to ensure that they have met these other
requirements.
