MDS is not applied to a proposed dwelling when the livestock facility in question is located on the same lot. Where a landowner owns a livestock facility on one lot, as well as an existing vacant adjacent lot on which they wish to develop or build, MDS I is applied to the development proposed for the adjacent lot, regardless of ownership.
