WOODSTOCK - A Brownsville resident has been convicted and fined for failing to properly dispose of dead animals. The charges arose from an investigation by the Ministry of Natural Resources (MNR).
On January 14, 2009, Richard John Clarke was convicted after a trial in the Ontario Court of Justice in Woodstock for two counts under the Dead Animal Disposal Act. The court heard that, following a complaint, MNR investigators visited Clarke's farm and found that he had failed to properly dispose of 29 dead cattle within 48 hours of death, contrary to the act. The offences occurred on April 28, 2008.
Justice of the Peace Mike McMahon sentenced
Clarke to a $1,000 fine for each count plus a victim fine surcharge, for a total
of $2,250.
The Dead Animal Disposal Act regulates the disposal of carcasses
of animals that died from causes other than slaughter, and for the licensing of
those engaged in this service. The act is administered by the Ontario Ministry
of Agriculture, Food and Rural Affairs (OMAFRA), with investigation and prosecution
services provided by MNR.
